Local Management's Failure to Comply
With Settlements and Awards
Burrus Update #7-02, March 28, 2002
At a Jan. 18, 2002, meeting I notified Postmaster General Potter about the union's concern over local management's failure to comply with grievance settlements and arbitration awards. At his request I provided him with a list of eight grievances that were representative of the problem. The USPS review of the list has led to further disagreement regarding the status of the cases. District and area managers say compliance is not a problem and when there are disagreements it is due to the failure of the union or the employee to provide necessary information.
The Industrial Relations Department has initiated a system for locals to inform the national union when management fails to comply with awards or settlements. However, unless the locals notify us, there is no way for the national union to know when management complies with awards or settlements that have been previously identified.
I am aware that management's failure to comply with arbitration awards is a major concern in the field and have received anecdotal information regarding specific cases. I will need more specific information and am requesting a list of all cases that are more than 90 days after settlement or decision where management has failed to comply.
