Department of Labor Rules For Election of Union Officers

Title IV of the Labor Management Reporting and Disclosure Act of 1959, as amended [PDF], sets forth rules that every union must follow when conducting elections of local officers and elections of delegates to state conventions where officers will be elected.

This publication contains a step-by-step guide for conducting an election of local officers using a polling place or mailed ballots. It lists the requirements of the law, gives suggestion on compliance, and describes common mistakes that local election officials make.

This publication provides recommendations to ensure that when ballots are mailed, local election officials are using the most up to date mailing list.

APWU Resources for Candidates and Election Committee Members

This two-page form satisfies the DOL requirement that candidates certify they have not been found guilty of a felony that would prohibit them from holding a union office. The form is also used for candidates to certify their acceptance of nomination and allow thier names to appear on a local ballot, and to affirm that they are in compliance with the APWU National Constitution and Bylaws.

Statement Concerning Postal Union Political Literature on Union Bulletin Boards

Under federal law, it is illegal to use union property to campaign for union office. This prohibition applies to using union bulletin boards, copy machines, and all other union property for campaign purposes, and it is strictly enforced by the U.S. Department of Labor.

The APWU national Secretary-Treasurers’ office advises local election committees to not permit campaign literature to be posted on union bulletin boards. Union bulletin boards are where members who cannot attend meetings get the “word” about their union and what their representatives are doing. Since campaign literature cannot be censored, locals risk having offensive or divisive campaign material posted on their bulletin boards. Union bulletin boards should be for official union business, not as places for candidates to disparage one another.

However, if a local union decides to allow posting of political literature on its bulletin boards, it must make them available to all candidates on an equal basis. This means that all candidates for the office must be informed of the availability of the bulletin boards for campaign purposes and given a fair and equal opportunity to have their literature posted.

09/21/2016 - APWU members and guests are invited to attend the Installation of National Officers Dinner on Saturday, Nov. 5, at the Washington Hilton Hotel, 1919 Connecticut Ave NW, Washington DC 20009, (202) 483-3000. The ceremonial affair will feature the swearing-in of new and returning officers and the ticket price for this event is $85 per person. The program will begin with a reception at 5 p.m. and the installation of officers will begin at 6:30 p.m.

09/15/2016 - Ballots for the American Postal Workers Union’s 2016 election of national officers were mailed to all eligible APWU members Sept. 10-15.

To be counted, the ballots must be returned to and received in the designated post office box by 2 p.m. (EDT) on Wednesday, Oct. 5. To be eligible to vote, a member must have been in “good standing” according to the official records of the national union on June 24.

Ballots for the American Postal Workers Union’s 2016 election of national officers were mailed to all eligible APWU members Sept. 10-15. The ballots must be returned to and received in the designated post office box by 2 p.m. (EDT) on Wednesday, Oct. 5. To be eligible to vote, a member must be in “good standing” according to the official records of the national union on June 24 of the election year.

Direct election of union officers has been a hallmark of the APWU’s democratic tradition, and in these turbulent times, it is especially important that union members raise their voice by voting.

Exercising the right to vote is a simple matter of marking the ballot – which will be mailed to your home – and returning the completed ballot in a postage-paid envelope.

09/09/2016 - Ballots for the 2016 Election of APWU National Officers will be mailed to members’ homes Saturday, Sept. 10, to Thursday, Sept. 15. All members “in good standing” as of June 24, 2016, will receive a ballot.

To be counted, ballots must be returned to and received  in the designated post office box in Washington, DC, by 2 p.m. on Wednesday, Oct. 5.

APWU Website 'De-Links' Local Websites During Union Election Period

05/01/2016 - The APWU national election period has begun, and in approximately five months, on Oct. 5, the counting of ballots will begin. Effective May 1, the national APWU website "de-linked" all local and state websites for the duration of the union election period. The links will be restored at the conclusion of the election cycle. The APWU took this action to avoid problems or complaints that could result if any locals or state organizations used their websites in violation of regulations regarding union elections promulgated by the Department of Labor.
