"The Struggle Continues" - Moe Biller

The American Postal Workers Union (APWU) and the United States Postal Service (USPS) are in the process of contract negotiations. It is no secret that MVS faces very challenging times during this round of negotiations. The USPS, inspired by the White House, is pushing an agenda of privatization and trying to turn middle class jobs into part-time positions.

The Postal Service will advance an agenda of cheap labor called “efficiency” in an attempt to extract concessions from many years of bargaining between the parties. Postal management’s agenda is to duplicate the business models of Wal-Mart, Target, UPS and other for-profit corporations that have little regard for hourly employees. In this model of corporate greed, many benefits achieved by the APWU over the years – such as a 40-hour work week, penalty overtime, and scheduled off days – could become a thing of the past. Although the APWU MVS Division has submitted numerous proposals, we have yet to receive any proposals from the USPS, so we are virtually negotiating with ourselves. On top of that, our current Collective Bargaining Agreement expires on September 20.

On August 18, 2016, during our last convention in Orlando, the Motor Vehicle Division received one of the most important arbitration decisions relating to Article 32.2.B and the renewal of Highway Contract Routes (HCRs).

New USPS cargo trucks and spotters were scheduled to begin deployment in April. The Postal Service conducted the First Article Testing (FAT) on the Ottawa Spotters and the Peterbilt 18' and 24' cab-over and cab behind engines. The spotters were tested in Ottawa, KS and the cargo trucks were tested in New Carlisle, IN.

MVS New Hire Salary Dispute Settled

02/05/2018 - On Jan. 26, the MVS Division and the USPS settled Class Action Grievance USPS NO. Q15V-4Q-C17473798/APWU No. HQTV20170179.

In the settlement, the parties agreed that when an external posting to hire contains an incorrect salary for the position in question, the Postal Service may correct the error pre-employment. Correction of the error must be made prior to a written job offer being accepted by the applicant.

The Postal Service & the DOT Physical

On Feb. 26, 1995, the Postal Service informed the APWU that to be consistent with the trucking industry and its own contract drivers, USPS would voluntarily mirror DOT requirements covering physicals for Commercial Driver’s License (CDL) employees, including the issuance of a medical card and drug and alcohol testing. The federal government is exempt from Department of Transportation (DOT) regulations, under 49 CFR 390.3(f)(2).

USPS Concedes that Schedule Examiner Work is Bargaining Unit Work

As we mentioned in a previous article, the union put its case for preserving the Schedule Examiner Vehicle Runs position before Arbitrator Shyam Das on Feb. 27 as the first case on the docket this year. As a long-standing issue, we considered this case an important step in preserving skilled Motor Vehicle Service work. It was the union’s position that the Postal Service was in violation of Article 1.6 of the National Agreement by assigning work normally performed by the Schedule Examiner to supervisory and Executive and Administrative Schedule employees; the Postal Service took the position that the case should be bifurcated on the grounds of arbitrability.

MVO/TTO Qualification Standards Settlement

The APWU and the Postal Service finalized a settlement on May 9, 2017 resolving national case A19V20021, concerning the 2002 changes made to the Motor Vehicle Operator (MVO) and Tractor-Trailer Operator (TTO) Qualification Standards. The union filed an appeal to arbitration in 2002 in response to unanswered questions and concerns with the changes that had been made, including increasing the experience requirement from one year to two and the elimination of the language, “those who pass the Postal Service road test on a tractor-trailer will be considered the meet the six month requirement.”

New Contractual Agreements in the MVS Craft

After extensive negotiations and interest arbitration, the motor Vehicle Division was successful in amending key sections of Article 39 of the Collective Bargaining Agreement, which governs the MVS Craft. We also were successful in writing a new Memorandum of Understanding (MOU) Re: Highway Contract Routes (HCRs).

The new agreements significantly improve the contract and add protections for members of the MVS Craft. Our fight to keep Postal Vehicle Service (PVS) work and prevent the Postal Service from undermining the contractual rights of employees will continue, but the new provisions are important steps forward.
