This Step 4 Settlement Agreement involved whether the grievant, who was hearing impaired, was given appropriate on-the-job training (OJT) for the position of Mailing Requirements Clerk and whether the grievant was discriminated against by her OJT instructor. After reviewing this matter, the parties mutually agreed that whether management violated Article 37, Section 3.F., of the National Agreement in this instance, was a matter suitable for regional determination. The issue of alleged discrimination is a nonintepretive issue to be resolved by full development of the specific fact circumstances. Accordingly, the parties agreed to remand this case to the parties at Step 3 for further processing including arbitration, if necessary.
